Late yesterday, the Town Council decided to get a county Circuit Court judge to decide if the proposed Charter Referendum language is constitutional before it can go on the February ballot.  In addition, according to the legal opinion from the Town attorney, the proposed referendum "arguably conflicts with the state comprehensive planning law, which restricts the use of the initiative or referendum process in regard to development orders affecting 5 or fewer parcels of land."
